Terms & Conditions

These terms and conditions apply to The Sleep Centre (Thanet) Ltd, trading as The Sleep Centre, or The Sleep Centre Bed Superstore from their premises at 161 High Street Ramsgate, Kent CT11 9RZ. Also applies to the Baby Sleep Centre store within The Sleep Centre.

1. The information contained on our web site or on any advertisement written, or by media does not constitute an offer to contract or enter into an agreement.

2. We, the retail stockist, shall not be obliged to accept your order. Your order, confirming the exact details of the items required with full delivery instructions, should be sent to us in an email, or by letter by post, by letter by fax, or by verbal message by telephone. Where required we will provide a confirmation of the order.

3. Any contracts or agreements formed between you and us, the retailer, by any of the means shall be governed and construed according to English law and any disputes and proceedings shall be subject to the exclusive jurisdiction of English courts.

4. While we try to ensure that all details including prices displayed on our web site and other advertisements are correct and up to date, we cannot guarantee that they are. Nevertheless we try to keep any form of advertisement as up to date as possible.

5. If purchasing an item seen on the website or any other form of advertising you must ensure that prior to placing an order, you have checked all the relevant details about the products you have selected as their relevant details may have changed since you last visited the website, or that there has not been a more recent advertisement.

6. You must ensure that the goods are correct for your requirements before ordering, in all respects, If ordering a bed or mattress please ensure that the product is correct for your needs, preferably by trying the item before hand. We cannot refund or exchange goods without good reason, or because the items was not as expected. Especially for such reasons as " it's too hard" or "it's too soft" or "I ordered the wrong size" . Mistakes along these lines are the responsibility of the customer and we will not be responsible in any way. It is the customers' responsibility to ensure that the item, is correct in all respects for their needs, as we do not exchange of refund after purchase due to poor choice by the customer.

7. The company is covered by all required liability and indemnity insurance, copies of which are on display within the store. We deem that our insurance cover relating to home deliveries applies only to the boundaries of a customer property whether retail or commercial. If asked to provide services within the customers property this is entirely at the customers risk and they should ascertain that they are covered on their own insurance. We do not accept liability for incidents or accident arising within customers homes or property. If services are requested of our personnel relating to delivering goods within the customers homes, all precautions should be taken before arrival to allow any delivery with ease. This includes, but is not limited to, all items on the floor that could pose a trip hazard, to remove the risk of any sharp obstructions whether usually fixed or movable, removal of items from staircases, such as pictures, photographs, ornamental items such as plates, statues, flower arrangements, removal of door handles, coat hooks or keys. Moving of any furniture or items that pose an obstruction to delivery as requested by the customer is the customer's responsibility.

8. Full payment for goods ordered is normally taken at time of order by cash, personal cheque, credit card or bankers cheque. Deposits taken on orders are at our discretion, and any balance becomes due before delivery of goods. Orders are usually processed to our manufacturers within one working day. Customers must ensure that all details given, such as delivery address, are correct to enable prompt delivery to take place. We have to provide many of our suppliers written confirmation of the fact that the end user customer has paid for the goods in full before they will deliver to them, to avoid fraudulent purchases. We may ask for additional information when a customer uses a credit/debit card to pay for goods or services, this is purely information asked for by our card processing authority HSBC Bank Plc to help cut fraud. We allow a period of 7 working days for bank cheques to clear before goods are released.

9. An approximate delivery period can be offered at time of order but The Sleep Centre can not be held responsible for unforeseen delays by manufacturers, or delivery companies employed by us or our suppliers. Extended deliveries can also be caused by U.K. summer/winter holiday periods, and National Holidays. We will give you the best information on delivery times we can at the time. We cannot accept cancellations of orders because delivery times have exceeded any estimates whether written or verbal.

10. We do not allow exchanges or refunds on the basis that the customer has changed their mind on their purchase or the item is no longer needed for whatever reason. Where we accept goods for exchange or refund at our discretion we are not liable to refund either the original ,or customers return, delivery costs or postage for mail order items and we reserve the right to charge a cancellation charge of 25% of the total retail value ( inc delivery costs if applicable ). Where delivery costs are included or free, we reserve the right to charge an unlimited amount for return or collection costs if we have to make the arrangements. Collections can be charged for at a greater amount than the original delivery costs charged at our discretion. Refunds will not be granted on any item found to be unpacked, damaged, used, or soiled in any way. The customer returns goods at their risk, and must obtain a suitable receipt and insurance cover should the customer use carriers or postal services. Special size or specially made items are not returnable under any circumstances. Refunds will be made by the same method of payment originally made, i.e. if you paid in cash we will refund in cash. Credit card refunds must be applied to the same card as was originally used and are not transferable to a third party as this breaks current UK law regarding money laundering. This does not affect your rights as a consumer under the Distance Selling Law.

11. If goods have been ordered by us from a third party supplier it is usually not possible to cancel goods once placed on order. Should a customer place an order with us, then we place the order with the supplier in good faith and therefore do not accept responsibility if the customer no longer wishes to continue with the purchase. The goods will be delivered to us in due course and we will notify the customer of their arrival. Should the customer no longer wish to have the goods delivered we reserve the right to dispose of the goods after a period of one month in storage.

12. All items sold by The Sleep Centre are covered by our own one year guarantee against manufacturing defects. During this period we will replace or repair any genuinely faulty or broken item free of charge. However, some manufacturers operate a longer free guarantee, or a 'wear and tear' warranty where the goods are covered for more than the first year but a charge 'pro-rata' for the amount of years used may be incurred on a replacement item. If we or our suppliers replace any item the original purchase day date remains the first day of the guarantee period, it is not extended from the date of the replacement. You must keep your original receipt for any claim under manufacturers extended guarantees as this is normally dealt with direct with the supplier. It is not the responsibility of this company to liaise with third party suppliers involving extended guarantees, although we may at our discretion report the claim to them on the customers behalf. Agents or representatives from the supplier would then normally inspect the item and take any appropriate action direct. If a replacement is required the supplier may send it direct to the customer, or employ us to deliver on their behalf. The Sleep Centre cannot involve itself in any disputes regarding guarantees or warranties over our normal 1 year period, this is between the customer and the manufacturer/supplier.

13. This company will not accept cash payments in excess of £ 5,000.00 for any order. This is due to current UK law regarding money laundering.

14. We reserve the right to withhold delivery on any order in order to ascertain that payment by cheque, bankers draft, or building society cheque is genuine and payment will be paid on any such method.

15. All goods must be inspected on delivery for any defects or faults or damage and any such problems must be notified within 24 hours of delivery by telephone.

16. All the beds sold by The Sleep Centre are expected to give good service in relation to the price paid by the customer but we cannot entertain unreasonable complaints resulting from customers own actions not normally associated with beds i.e. " the bed was broken by my children using it as a trampoline ", " the side rail on the pine bed snapped whilst I stood on it to change the light bulb " etc. etc. Complaints such as these will not be considered reasonable unfortunately. Any compliant should be made in writing giving as much information as possible and a copy of the original purchase receipt. Sleep Centre staff, or agents working on our behalf will the inspect the alleged faulty item and make a written report and action will be taken based on that information. Should our supplier deem that there is no fault to rectify, we will abide by their decision.

17. The Sleep Centre ( Thanet ) Ltd process all personal data in accordance with the Data Protection Act 1998.Data provided to The Sleep Centre ( Thanet ) Ltd will be kept in web logs, or on computer hard drive, and may be used by this company for direct future marketing by email or post, customer base and product sales examination.

The Sleep Centre ( Thanet ) Ltd only requires the personal details that are necessary for the successful conclusion of orders or enquiries.

The Sleep Centre ( Thanet ) Ltd may occasionaly send by e-mail, information on new products, news or special offers, if you wish to be removed from our lists then simply click on the web link at the bottom of the e-mail you receive, and you will be removed from the email list.

The Sleep Centre ( Thanet ) Ltd will not pass any details provided to a third party, unless requested to by the customer, i.e. for registering extended warranties.

The Sleep Centre ( Thanet ) Ltd will take all reasonable steps to protect any personal information provided but cannot guarantee the security of data provided on-line. Buyers must accept the risk of providing such data over the internet and The Sleep Centre ( Thanet ) Ltd cannot be held responsible for any breach of security unless this is due to negligence on behalf of the company.

18. Special Offer and reduced Sale price goods are ‘Sold as Seen’ and should be inspected before purchase. We do not 'buy -in' special lower quality goods for sale periods. Any item reduced has normally been on sale within the Sleep Centre for a period before the sale starts, at the higher price shown in compliance with current laws in force.

19. We do not inflate any of our prices using so-called ‘Manufacturers Recommended Retail Prices’ to then amazingly reduce them as Sale Prices. Recently some local stores have claimed to offer as much as 70 % off their prices, of course this is impossible. These higher prices are simply made up ‘original’ or ’previous’ prices, and then the stores normal price then looks like it is a massive saving. At The Sleep Centre we believe that this practice of advertising is dishonest. The price that we show on any item is the price that we expect to receive for that item. We do not offer discounts for cash purchases.

20. We price all our products as keenly as possible to offer the customer the best value all year round. Special Offer and reduced Sale price goods are genuinely reduced, normally to clear discontinued models or because there is a defect which warrants a reduction.

21. All products are subject to availability. All prices are inclusive of VAT at the prevailing UK rate.

22. The contract price of any product is the price in force at the time of your order or (if lower) the price in force at the time when your confirmation email or letter is sent.

23. No statement on these terms and conditions shall be deemed to affect the statutory rights of a consumer which cannot be excluded or restricted by law.

24. This website contains material that is owned by or licensed to The Sleep Centre ( Thanet ) Ltd. This material includes, but is not limited to, the design, layout, look, appearance and graphics. It is protected by intellectual property laws including, but not limited to, copyright. All trademarks reproduced in this website, which are not the property of, or licensed to The Sleep Centre ( Thanet ) Ltd., are acknowledged on the website. You may view, use, download and store the material on this website for personal and research use only. Commercial use is not permitted. The re-distribution, re-publication, or otherwise making available of the material on this website to third parties without the prior written consent of The Sleep Centre ( Thanet ) Ltd. is prohibited. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

25. The retail store, any internet trading and this website is controlled and operated by The Sleep Centre ( Thanet ) Ltd. from its offices in England. The formation, existence, construction, performance, validity in all aspects whatsoever of these terms and conditions or of any term of these terms and conditions or any dispute in relation to the materials contained in this website shall be governed by English law. The English and Welsh courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these terms and conditions or use of the website. Your continued use of this website indicates your acceptance of these terms and conditions. Unfortunately, if you do not accept these terms we must require you to stop using our website and terminate your licence to use it.
